Texas family law gives fathers the same legal standing as mothers when courts decide conservatorship and possession. Family Code 153.003 explicitly prohibits courts from favoring either parent based on sex or marital status. What matters is the best interest of the child, and understanding how courts apply that standard is where the right legal counsel makes a real difference.

How Texas Family Law Defines “Custody”

Texas courts don’t use the word “custody.” The Family Code splits the concept into two distinct categories: conservatorship and possession and access. Conservatorship covers decision-making authority over a child’s education, health care, and religious upbringing. Possession and access is the actual parenting-time schedule.

Courts typically award joint managing conservatorship, meaning both parents share rights and duties. One parent is usually designated with the exclusive right to determine the child’s primary residence, but that designation doesn’t settle parenting time. The possession schedule is set separately, and joint managing conservatorship doesn’t automatically mean equal time with the child.

Establishing Paternity for Unmarried Fathers in Texas

A father who was married to the child’s mother at birth is automatically presumed to be the legal father under Texas law. An unmarried father has no such automatic recognition, even if his name appears on the birth certificate. Until legal paternity is established, an unmarried father has no standing to seek conservatorship or possession.

There are two paths to legal paternity:

Acknowledgment of Paternity: Both parents sign and file this document with the Texas Vital Statistics Unit. It’s a voluntary process that works when paternity isn’t disputed.
Court adjudication: Either parent can file a parentage action. If paternity is contested, the court can order genetic testing to resolve the question.

Once paternity is established by either method, a father holds the same legal standing as a married father and can pursue conservatorship, possession, and participation in decisions about the child’s education and health care.

Standard & Expanded Possession Orders in Texas

When parents don’t reach their own agreement, Texas courts apply a default possession schedule. The Standard Possession Order gives the noncustodial parent time on the first, third, and fifth weekends of each month, Thursday evenings during the school year, alternating holidays, and extended summer time.

In 2021, the Texas Legislature amended Family Code 153.3171 to establish an Expanded Standard Possession Order. When parents live 50 miles or less apart, this schedule is presumed to serve the child’s best interest. It adds a Thursday overnight through Monday morning during the school year and brings the noncustodial parent’s total time to roughly 47% of the year. Courts can depart from either schedule when the child is under three years old or when the standard arrangement doesn’t serve the child’s best interest on the specific facts.

Fathers’ family law matters in Houston are heard in the Harris County family district courts, located at the Harris County Civil Courthouse in downtown Houston. We have handled family law cases in Harris County since 2000 and are familiar with the procedures and expectations of those courts.

Modifying an Existing Conservatorship or Possession Order

Life changes after an order is entered. A new job with different hours, a proposed relocation, or a child’s evolving needs can all make an existing parenting arrangement unworkable. Under Family Code 156.101, a parent seeking to modify conservatorship or possession generally must show a material and substantial change in circumstances since the original order was rendered.

Common triggers include a parent’s relocation, a significant shift in work schedule, or changes in the child’s school or medical needs as they grow older. The threshold matters: not every change qualifies, and the court still applies the best-interest standard when deciding whether a new arrangement is warranted.
